Being in the U.S. illegally is a federal crime, most commonly addressed as improper entry by alien under 8 U.S.C. § 1325. This can lead to criminal penalties such as fines and imprisonment, with penalties increasing for repeat offenses. Other federal immigration crimes include alien smuggling and illegal reentry (for those who have previously been deported).
